Terms of service

1. Scope
These terms apply to all contracts between Luxuria and business customers (agents, developers, agencies, other companies) for the production of property videos. We do not contract with consumers. Deviating terms of the customer apply only with Luxuria's written consent.
2. Service
Luxuria produces videos with camera movement from property photos provided by the customer. Production uses AI-based image and video processes; planning, selection, checking and editing are done by Luxuria. Scope, number, format (default 16:9, 1080p) and duration follow the respective offer or package. Music and logo overlay are provided on request as stated in the offer.
3. Test video
A first test video is produced free of charge and without further obligation on request. It may carry a watermark and may not be used commercially without an order.
4. Customer obligations
The customer provides photos in sufficient resolution and without watermarks and warrants to hold the rights required for video production and publication. The customer indemnifies Luxuria against third-party claims arising from a breach of this warranty. Luxuria may reject photo sets unsuitable for video production and will say so before production starts.
5. Prices and payment
All prices are net of applicable VAT. Packages are invoiced on order, single videos on delivery. Invoices are due within 14 days without deduction. Retainers are invoiced monthly in advance.
6. Delivery, acceptance, revisions
Delivery usually takes 48 hours after receipt of complete photos; this is a guideline, not a fixed deadline. Delivery is digital as a download. The revision rounds named in the respective package are included; further changes are offered at cost. Complaints must be raised within 7 days of delivery, after which the video is deemed accepted.
7. AI-generated content
Videos are created with generative processes. Despite careful checking, individual image content may deviate from the photographed property (for example details of furniture, textures or perspectives). Luxuria checks every video before delivery and replaces objected shots within the revision rounds. The customer checks the video for consistency with the property before publication and is responsible for its use in listings, including compliance with competition and brokerage regulations.
8. Usage rights
Upon full payment the customer receives the non-exclusive right, unlimited in time, territory and content, to use, reproduce and make available the delivered videos for marketing the respective properties and for self-promotion. Luxuria may use delivered videos as references for its own advertising unless the customer objects when ordering.
9. Retainers
Monthly retainers have a minimum term of three months and can then be terminated with 14 days' notice to the end of a month. Unused video quotas expire at month end unless agreed otherwise.
10. Liability
Luxuria is liable for intent and gross negligence. In cases of slight negligence Luxuria is liable only for breach of essential contractual obligations, limited to the order value. Liability for lost profit and indirect damages is excluded to the extent permitted by law. The customer is liable for the accuracy of the photos and information provided.
11. Confidentiality and data
Photos and property information are treated confidentially and used only to deliver the service. The privacy policy applies.
12. Final provisions
The law of the State of New Mexico, USA, applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory provisions of the customer's home state remain unaffected for customers established in the EU. Place of jurisdiction, where permissible, is Albuquerque, New Mexico. Should individual provisions be invalid, the remainder of the contract remains in force. Amendments require written form; email suffices.
